US House Passes War Powers Resolution

The US House of Representatives on 3 June voted 215–208 to approve a War Powers resolution aimed at ending military hostilities against Iran, coming just weeks after the Senate approved a similar resolution following seven failed attempts to rein in the US president. Introduced by Representative Gregory Meeks, the measure passed with the support of all House Democrats and four Republicans who broke party ranks to reassert congressional authority over war powers. The resolution relies on the 1973 War Powers Act, which requires the president to terminate unauthorized military action within 60 days of the vote passing.

As a crucial legal deadline for the U.S.’s unauthorized war in Iran approaches later this week, President Donald Trump may opt to ignore it altogether — and Republican leaders in Congress may allow him to. Trump launched the joint U.S.-Israel war in Iran almost two months ago. According to the War Powers Resolution of 1973, any military action taken by a president without congressional approval must be reported on. And so, in the first week of March, the administration submitted a written declaration of its actions to Congress.

The US government has continued to accelerate its drive to war with Venezuela. While rumors circulate about phone calls and possible talks between US President Donald Trump and Venezuelan President Nicolás Maduro, in tandem, the US head of state has continued to launch bizarre and illegal threats and accusations against the South American nation. On Saturday, November 29, Trump unilaterally declared that Venezuelan airspace was closed, despite international law stipulating that only Venezuela has authority over the airspace above its territory and reports that air traffic above Venezuela has since continued.

Bipartisan Lawmakers Push To Limit Trump’s War Powers On Iran

In response to Donald Trump’s recent declaration that the U.S. could become involved in Israel’s attacks on Iran, U.S. lawmakers are pushing efforts to curb the President’s war powers. Reps. Thomas Massie (R-KY.) and Ro Khanna (D-CA) are introducing a bipartisan bill that would force Trump to obtain congressional approval to enter the war. “This is not our war,” tweeted Massie. “But if it were, Congress must decide such matters according to our Constitution. I’m introducing a bipartisan War Powers Resolution tomorrow to prohibit our involvement. I invite all members of Congress to cosponsor this resolution.”

War Powers Resolution ‘Riddled With Holes’

Francis Boyle is a professor of international law at the University of Illinois College of Law. He said today regarding moves in Congress on Iran: “The Kaine resolution and the Slotkin resolution are riddled with so many holes that Trump/Pompeo et al. will drive a truck through them. The legislation proposed by Ro Khanna and Sanders has some problematic rhetoric, which should be dropped, but it is not in the operative provisions and it is consistent with the War Powers Resolution and the War Powers Clause of the Constitution and the United Nations Charter and would make a real difference.” Boyle noted: “Slotkin’s — who notably came out of the CIA — resolution talks of the president being free to act in case of ‘an imminent armed attack.’ This is not consistent with the War Powers Resolution and will likely assist Trump committing aggression.

War Powers Act Against Yemen War Moves Ahead In US Senate

The US Senate’s floor vote of 63 to 37 to invoke the War Powers Resolution to end the US role in the Saudi and United Arab Emirates war in Yemen is “historic” and will likely be followed by House passage of a companion resolution. Now that the Senate has passed this resolution, the House is likely to follow suit. The companion resolution introduced by Rep. Ro Khanna (D-CA), H.Con.Res. 138, has 93 cosponsors.
