Greenpeace Remains Determined To Fight Corporate Silencing Of Dissent

In March, Greenpeace organizers and supporters found themselves waiting for a jury verdict in a North Dakota courthouse. Knowing the decision in this civil court case could force the organization to pay hundreds of millions in damages, many found themselves wondering how things had reached this point. “We were still asking, why are we even in this courtroom?” said Madison Carter, a spokesperson for Greenpeace USA. Pipeline builder Energy Transfer launched the lawsuit in 2019 against Greenpeace USA and Greenpeace International, but its allegations — of defamation, false statements to banks, and aiding and abetting property damage — stemmed from the 2016 mass protests against the Dakota Access oil pipeline at Standing Rock. Greenpeace flatly denies all the charges.

New Report Shows A Surge In European SLAPP Suits

Lawsuits to silence those speaking out and fighting in the interest of the public are increasingly being used as a form of private censorship, according to a new report published last week by the Coalition Against SLAPPS in Europe, or CASE. Developed in collaboration with the Daphne Caruana Galizia Foundation, the report shows that SLAPPs continue to rise in Europe and identifies a total of 1,049 cases between 2010-2023. The lawsuits cover a broad range of topics, and environmental issues made up the second-most-targeted subject of all the SLAPP suits reported, behind corruption.

Greenpeace International Uses First EU Anti-SLAPP Directive

Amsterdam, Netherlands — Greenpeace International pushed back today against a meritless, US $300 million lawsuit from US-based fossil fuel company Energy Transfer by sending a Notice of Liability to its headquarters in Dallas, Texas. The Notice of Liability informs Energy Transfer (ET) of Greenpeace International’s intention to bring a lawsuit against the company in a Dutch Court to recover all damage and costs it has suffered as a result of the SLAPP suit, unless ET withdraws its case and accepts responsibility for the harm Greenpeace International has suffered.[1]  The Notice of Liability marks the first application of the new European Union anti-SLAPP Directive.
