The Border Isn’t A Rights-Free Zone

An American family that underwent a harrowing detention at the hands of U.S. Customs and Border Protection can now seek some measure of justice. That’s the result of a recent ruling by the federal judge presiding over the lawsuit we filed on behalf of Abdisalam Wilwal, Sagal Abdigani, and their four young children after a brutal experience at the U.S.-Canada border. The Wilwal-Abdigani family was on the way home to the Minneapolis area from a trip to visit relatives in Canada when they pulled up to the border station at Portal, North Dakota. Shortly after they handed over their passports and birth certificates, CBP officers swarmed the family’s minivan with guns drawn, forced the father out of the car, and handcuffed him.

By Robert Jensen for Waging Nonviolence - From a “critique” of my work on the recently launched website Professor Watchlist, I learned that I’m a threat to my students for contending that we won’t end men’s violence against women “if we do not address the toxic notions about masculinity in patriarchy … rooted in control, conquest, aggression.” That quote is supposedly “evidence” for why I am one of those college professors who, according to the watchlist’s mission statement, “discriminate against conservative students, promote anti-American values and advance leftist propaganda in the classroom.”

"The Department of State then opened an investigation into Plaintiff McGovern, including specifically his lawful, protected political beliefs, activities, statements and associations which it kept open for nearly seven months, despite all charges having been dropped against Mr. McGovern and despite having determined that Mr. McGovern was engaged in no criminal activity." As the complaint states: "The Department of State issued a Be On The Lookout Alert ('BOLO Alert') for the then- 71-year-old McGOVERN which described his 'considerable amount of political activism, primarily anti-war,' displayed his picture and directed law enforcement that if Mr. McGOVERN was encountered, 'USE CAUTION, stop' and question him and contact the Department of State Diplomatic Security Command Center."
