Maine Proposes Major Staffing Increases For Care Facilities

In the first major update to assisted living and residential care regulations in more than 15 years, the Maine Department of Health and Human Services has proposed significantly increasing staffing requirements, among other changes. The proposed updates follow an investigation by The Maine Monitor and ProPublica into the state’s largest residential care facilities. It found dozens of violations of resident rights, including incidents of abuse and neglect, as well as more than 100 cases in which residents wandered away from their facilities and hundreds of medication and treatment violations.

Contrary to what many believe, the tens of thousands of deaths of those living in long-term care (LTC) were no inevitable biological catastrophe. Their grieving, angry family members know better: they know the conditions that prematurely deprived their loved ones of the remainder of their lives. By December, just as vaccine distribution started, nearly 110,000 residents and staffers had died. The extra deaths among our elders constitute an appalling percentage of the 1.4 million Americans who were living in nursing homes before the pandemic. These older adults were of all races, genders, ethnicities, religions, and political persuasions.

Overwhelming is the only way to describe the daily dose of tragic stories about vulnerable elders dying in mostly for-profit, long-term care facilities, such as the one in Washington state where our regional COVID outbreak began two months ago. But this should not be a surprise. The for-profit nursing home business has been in trouble for years. In February, B.C. Seniors Advocate Isobel Mackenzie tabled a report documenting many of the shortcomings of the for-profit care sector, such as higher administration costs and 207,000 funded but undelivered care hours. This is in contrast to a non-profit sector that actually spent more per resident than it was funded for on delivering direct care and service delivery. While the for-profit system has clearly failed, the non-profit system has its own problems.
