Computer scientist Nadia Heninger has argued that leaking information is now becoming the “civil disobedience of our age”. The late historian and activist Howard Zinn described the act of civil disobedience as “the deliberate, discriminate, violation of law for a vital social purpose”. He advocated it saying that such an act “becomes not only justifiable but necessary when a fundamental human right is at stake and when legal channels are inadequate for securing that right”. Snowden’s act was clearly one of civil disobedience. John Lewis, US Representative and veteran civil rights leader recently noted that Snowden was “continuing the tradition of civil disobedience by revealing details of classified US surveillance programs”.

The owner of an encrypted email service used by ex-NSA contractor Edward Snowden said he has been threatened with criminal charges for refusing to comply with a secret surveillance order to turn over information about his customers. "I could be arrested for this action," Ladar Levison told NBC News about his decision to shut down his company, Lavabit LLC, in protest over a secret court order he had received from a federal court that is overseeing the investigation into Snowden. Lavabit said he was barred by federal law from elaborating on the order or any of his communications with federal prosecutors.

After 9/11, many of the most important news outlets in America abdicated their role as a check to power — the journalistic responsibility to challenge the excesses of government — for fear of being seen as unpatriotic and punished in the market during a period of heightened nationalism. The Administration released a White Paper on Friday that summarized its claimed legal basis for the bulk collection of telephony metadata, also known as the Associational Tracking Program under section 215 of the Patriot Act, codified as 50 U.S.C. section 1861. While we’ll certainly be saying more about this analysis in the future, the paper makes one central point clear: There is no direct authorization for the Associational Tracking Program in section Patriot Act section 215. Nowhere does the statute say that the NSA may conduct bulk collection and analysis of the phone records of nonsuspect, nontargeted Americans on an ongoing basis, including requiring the production of records that haven’t even been produced yet.

Evo Morales, President of Bolivia, announced yesterday that he will propose UNASUR to bring the US before an international tribunal for human rights violations after his plane was denied airspace in Europe in the beginning of July. Speaking yesterday to local newspaper La Razón, Morales announced that “I’m going to propose in the next UNASUR meeting with all the other presidents to bring the United States before an international court in respect to human rights and international diplomacy treaties. This action is fundamental so that other presidents in the world will not have to go through what I went.”

As New York Times reporter James Risen (who knows a thing or two about whistleblowers) said on CNN recently, “We wouldn’t be having this discussion if it wasn’t for [Snowden]. That’s the thing I don’t understand about the climate in Washington these days, is that people want to have debates on television and elsewhere, but then you want to throw the people who start the debates in jail.” But Risen made another, less publicized appearance this week at the annual National Press Club awards dinner. What he said there is even more poignant. “I don’t think there’s any personality that’s more American than a whistleblower,” he said. “The entire personality and DNA of America [is made up] of people who wanted to have their own kind of government and be free of oppression. And I think that is the heart of what a whistleblower is. It’s somebody who believes civil liberties or freedom or corruption are important issues that they need to talk about and their right as an American is to talk about it with the press.”

The National Security Agency has a secret backdoor into its vast databases under a legal authority enabling it to search for US citizens' email and phone calls without a warrant, according to a top-secret document passed to the Guardian by Edward Snowden. The previously undisclosed rule change allows NSA operatives to hunt for individual Americans' communications using their name or other identifying information. Senator Ron Wyden told the Guardian that the law provides the NSA with a loophole potentially allowing "warrantless searches for the phone calls or emails of law-abiding Americans".

Remember when word circulated that Edward Snowden was using Lavabit, an email service that purports to provide better privacy and security for users than popular web-based free services like Gmail? Lavabit's owner has shut down the service, and posted a message on the lavabit.com home page today about wanting to avoid "being complicit in crimes against the American people." According to the statement, it appears he rejected a US court order to cooperate with the government in spying on users.

Greenwald: On Obama’s Cancellation of the Summit with Putin

President Obama today canceled a long-scheduled summit with Russian President Vladimir Putin in part because the US president is upset that Russia defied his personal directive to hand over Edward Snowden despite the lack of an extradition treaty between the two nations. That means that US media outlets will spend the next 24 hours or so channeling the government's views (excuse the redundancy) by denouncing the Russian evil of refusing extradition. When doing so, very few, if any, establishment media accounts will mention any of these cases.
