Green Party Urges International Criminal Court To Prosecute Israel For Crimes Against Palestinians

Members of the Green Party United States traveled to the International Criminal Court (ICC) on Monday, November 29, 2018 to deliver a letter calling for a full investigation of Israel for war crimes it has committed against the Palestinians. The Green Party recognizes that the United States is complicit in Israel’s crimes by providing financial support, selling weapons and providing political cover to Israel.

While relations between the U.S. and the ICC have fluctuated over the course of different administrations, the American government has steadfastly refused to take the step that 124 other states have of ratifying the Rome Statute and thus becoming a member of the international legal body. The ICC’s mandate to investigate war crimes has thus been hampered by the unwillingness of the world’s sole superpower to commit to the organization. Doctrines Of Impunity: John Bolton And The ICC

The Trump administration’s national security advisor John Bolton has never been a fan of international law, a concept he has found, at best, rubbery.  Any institution supposedly guided by its spirit was bound to draw the ire of both his temper and temperament.  Before members of the Federalist Society on Monday, Bolton took to the pulpit with a fury reserved for the unreflective patriot certain that his country, right or wrong, was above such matters.  “The United States will use any means necessary to protect our citizens and those of our allies from unjust prosecution by this illegitimate court.” The wicked body, in this instance, is the International Criminal Court, established by the Rome Statute to try instances of genocide, war crimes and crimes against humanity, a “court of last resort” backed by 123 nations.

The ICC Just Announced It Will Treat War As A Crime

The International Court of Justice (ICJ) could try the United States for attacking a country if (1) that country brought a case, and (2) the United States agreed to the process, and (3) the United States chose not to block any judgment by using its veto power at the U.N. Security Council. War is a crime. The International Criminal Court has just announced that it will finally treat it as a crime, sort-of, kind-of. But how can war’s status as a crime effectively deter the world’s leading war-maker from threatening and launching more wars, large and small? How can laws against war actually be put to use? How can the ICC’s announcement be made into something more than a pretense? The Kellogg-Briand Pact made war a crime in 1928, and various atrocities became criminal charges at Nuremberg and Tokyo because they were constituent parts of that larger crime.

ICC Launches Probe Into Israeli War Crimes In Palestine

Israel's fear that Palestinian recognition by the International Criminal Court would bring unwelcome scrutiny of its military actions took a step closer to fruition on Friday, when the the ICC announced a preliminary probe into possible war crimes committed in occupied territories. Chief prosecutor Fatou Bensouda vowed “full independence and impartiality” in "examining the information available." The probe was procedural, she said, and would determine whether evidence of possible war crimes by Israel or by Palestinian entities required formal investigation. The announcement follows the Palestinian Authority’s agreeing to the court's founding treaty and recognizing its jurisdiction dating back to the eve of last summer's Gaza war. Israel is not party to the treaty, nor is the United States. While Palestinian membership in the ICC doesn't automatically incur U.S. punishment, existing legislation requires that any Palestinian case brought against Israel at the court could trigger an immediate cutoff of U.S. financial support.
