Popular Resistance Newsletter – MIA: Rule of Law

At the entrance to the New York City Courthouse, the words “Where Law Ends There Tyranny Begins” are inscribed in the marble wall. Our constitutional rights, particularly the first and fourth amendment rights, are disappearing. And the US government and national security state behave as if they are above the law. MIA Rule of Law risks the further division in the United States as the people see no path to justice. Private corporations contracted by the US government and others are tracking activists by monitoring social media and using geo-location tools.

Bradley Manning Defense Rests it Case

On the final day of Bradley Manning’s defense’s case, Harvard Law Professor and renowned scholar Yochai Benkler testified about how the Internet changes journalism’s function in a democracy, how WikiLeaks was viewed over time, and why WikiLeaks should be considered a legitimate news organization, devoted to exposing corruption. Benkler’s testimony is crucial to undercutting the government’s core argument that Bradley Manning intended to give documents indirectly to al Qaeda by passing them to WikiLeaks. Whereas the prosecution has spent weeks characterizing WikiLeaks as a reckless collective that terrorists were known to visit, Benkler said, “WikiLeaks played that critical role of that particular critical component of what muck-raking and investigative journalism has always done.”

Worldwide Action for Bradley Manning Before His Final Verdict

Please join us in what will likely be the last worldwide coordinated show of support for Army whistleblower Bradley Manning before military judge Col. Denise Lind reads her final verdict–which we expect some time in August. The July 27 Worldwide Day of Action coincides with the anticipated sentencing phase of Bradley’s trial. The outcome of that phase of the trial will result in Bradley receiving any outcome from time served to life in prison.

Fort Meade Cops Pull Over Wikileaks Truck for Disseminating “Top Secret Info”

Who knew that the WikiLeaks Truck was chock full of Top Secret Info?... just like it says in bold lettering on the side! Clark Stoeckley was pulled over this evening while driving the WikiLeaks Truck–no connection to media group WikiLeaks–after a long day at Fort Meade covering whistleblower Bradley Manning’s trial. Stoeckley is a cartoonist who has published a book about Manning’s pre-trial hearings.

Bradley Manning Defense Moves to Dismiss Charges

The government rested its case against Bradley Manning last week, and the defense began its case today with the announcement that it filed four motions to direct a not-guilty verdict. The defense moved to dismiss the aiding the enemy charge, a Computer Fraud and Abuse Act charge, the federal larceny charge, and specifically the charge that Manning “stole” the U.S. Forces in Iraq Global Address List. Prosecutors have until Thursday, July 11, to respond to that motion, after which Judge Denise Lind will rule. Judge Lind asked the defense to proceed despite that motion, and the defense began by playing the unedited version of the ‘Collateral Murder’ video, of U.S. Apache gunners shooting Iraqi civilians and Reuters journalists. Defense lawyer David Coombs played the video to verify that it matched a transcript of the video, which he entered as evidence.

Lack of Transparency Means Tainted Justice for Bradley Manning

The lack of contemporaneous access to court documents has caused irreparable harm to the American public's right to scrutinize the conduct of military prosecutors and the rulings of the presiding military judge. This will surely taint the final outcome of Pfc Bradley Manning's trial. "Military confinement. That's like a term of art," said the spokesperson for the military district of Washington (MDW) - which is responsible for convening a fair and impartial trial for the accused - to an American TV reporter last summer. The reporter was known for investigating infotainment websites during pre-trial sessions. "The practical effect?" commented the spokesman to the reporter. "He's in jail."

Surprising Lack of Evidence Against Manning Confirms Over-Prosecution

On February 28, 2013, Pfc. Bradley Manning pled guilty to ten lesser offenses that could have put him in jail for up to 20 years, taking responsibility for releasing classified documents to WikiLeaks as an act of conscience. But that wasn’t enough for prosecutors, who decided to move forward on all counts, seeking to imprison Manning for the rest of his life, without a chance for parole. The government said it could prove Manning knew that by dealing with WikiLeaks he was dealing al Qaeda. But now that the government has rested its case, many have been shocked to see that prosecutors’ evidence is weak, ambiguous, and circumstantial. It appears that the government is more interested in trying to connect tangential dots, in order to smear a heroic whistleblower as a traitor, than seeking any type of justice.

Taking PRIDE in Bradley Manning

With Bradley Manning’s court martial in full swing, Bradley Manning contingents marched in PRIDE parades around the country and world. Supporters organized street theatre performances, parade floats, and in SF an airplane swooped over the event carrying a Free Bradley Manning banner! All this public support for Bradley has sent a clear message: Bradley Manning is a heroic whistleblower, and enough is enough – he must be set free! The military cannot get away with having persecuted a gay soldier who did the right thing. Exposing war crimes is not a crime! Free Bradley Manning!

Popular Resistance Newsletter – Organized Resistance Brings Sweeping Change, Lessons for US

The big story of the week was Egypt. Protests organized by Tamarod (Rebel) that have been building for months, resulted in the biggest protest in Egypt’s history, four days of mass protest beginning on June 30 that ended the rule of President Mohamed Morsi. More than a week ago, Tamarod recommended that the head of the Egyptian Constitutional Court become the interim president and that is what the Egyptian military announced. The military made the announcement after lengthy meetings with religious groups, including minority religions; opposing political parties, including a Muslim party; and civil society including Tamarod.

Embarrassing’ Holes as US Govt Rests Case Against Bradley Manning

As Manning's defense team prepares to present their case next week, they are hoping Manning's prospects have risen after the government was forced to close their portion of the trial with an "embarrassing admission" that the Army had misplaced Manning's military contract, the Acceptable Use Policy (AUP) , which laid out the terms of his access to classified information. Ahead of the trial, Judge Colonel Denise Lind stated that in order to prove their charge of 'aiding the enemy' the prosecution must demonstrate beyond a reasonable doubt that Manning had "a general evil intent," in that he "had to know he was dealing, directly or indirectly, with an enemy of the US."

Over Thousand in Bradley Manning Support Contingent at SF Pride 2013

Over 1,000 supporters of openly gay whistle-blower, PFC Bradley Manning, marched in the Bradley Manning Support Network contingent in the SF Pride Parade today. The anchors of KOFY TV’s live coverage noted that it was the largest non-corporate contingent in the Parade, second only to Google overall. The contingent featured former military strategist Daniel Ellsberg who in 1971 leaked the Pentagon Papers to the New York Times. Ellsberg, adorned with a pink boa, rode on a pickup truck declaring Bradley Manning “The People’s Grand Marshal.” High above Market Street, an airplane dragged a banner reading “Our LGTBQ Hero – Bradley Manning”. Among the marchers was SF Pride’s legal counsel, Brooke Oliver, who recently resigned after 15 years because of the SF Pride Board’s handling of the Manning debacle. Bevan Dufty, former SF Supervisor and now the mayor's point person on homelessness, stepped down as a Grand Marshal, also because of the Pride Board’s actions.

Bradley Manning Should Win Nobel Peace Prize

Peace is more than simply the absence of war; it is the active creation of something better. Alfred Nobel recognized this when he created alongside those for chemistry, literature, medicine and physics, an annual prize for outstanding contributions in peace. Nobel's foresight is a reminder to us all that peace must be created, maintained, and advanced, and it is indeed possible for one individual to have an extraordinary impact. For this year's prize, I have chosen to nominate US Army Pfc Bradley Manning, for I can think of no one more deserving. His incredible disclosure of secret documents to Wikileaks helped end the Iraq War, and may have helped prevent further conflicts elsewhere.

Assange: Rebukes Kerry & Biden, Praises Manning & Snowden

Appearing exclusively on ABC's This Week on Sunday morning, WikiLeaks founder Julian Assange discussed his and NSA leaker Edward Snowden's respective asylum situations, as well as the United States' "disgraceful" treatment of Snowden in revoking his passport. Assange explained that the particular district in northern Virginia typically has jury pools made up of CIA and Pentagon workers, and is known as "rocket docket" for its "lack of scrutiny procedures" and high conviction rates. Assange said Secretary of State Kerry's statements that lives were put at risk was false, and Vice President Biden should not be pressuring Ecuador on asylum.
