On April 5, the United States revoked the visa of the International Criminal Court’s (ICC) chief prosecutor, Fatou Bensouda, for her attempts to open an investigation into alleged war crimes committed by the U.S. in Afghanistan. A week later, judges at the ICC rejected Bensouda’s request to open a probe into U.S. involvement in Afghanistan. While rights advocates condemned this move as amounting to U.S. interference in the workings of the ICC, it’s more alarming than mere obstruction — and is rooted in the pre-existing hierarchy and embedded colonial structures in international legal order.

Prosecutor Fatou Bensouda's office said she will continue her work for the Hague-based tribunal "without fear or favor." In a move human rights defenders decried as "shameful," the Trump administration revoked the visa of the International Criminal Court's chief prosecutor this week for trying to investigate alleged war crimes committed by American forces in Afghanistan. "What we can confirm is that the U.S. authorities have revoked the prosecutor's visa for entry into the U.S." Prosecutor Fatou Bensouda's office said in a statement. The decision, per her office, shouldn't interfere with her travel to the United Nations headquarters in New York City.

Today, the International Association of Democratic Lawyers presented a petition from the International Lawyers Campaign for the Investigation and Prosecution of Crimes Committed Against the Palestinian People to Fatou Bensouda, chief prosecutor of the ICC.

UN Court Issues Interim Order To US To Lift Some Iran Sanctions

The United Nations' top court has issued an interim order to the United States to lift sanctions linked to humanitarian goods and civil aviation imposed against Iran - a move welcomed by Tehran. "On humanitarian grounds, the US must remove by means of its choosing any impediment to the free exportation to Iran of goods involving humanitarian concerns," the International Court of Justice (ICJ) said in its ruling on Wednesday. The ICJ's rulings are binding, but it has no power to enforce them. "The decision proved once again that the Islamic Republic is right and the US sanctions against people and citizens of our country are illegal and cruel," Iran's foreign ministry said in a statement.

"John Bolton and the Trump administration are turning us away from international accountability and cooperation and towards war and unilateral aggression." —Win Without War Bolton also revealed that President Donald Trump "has decided that the United States will withdraw from the optional protocol on dispute resolution to the Vienna Convention on Diplomatic Relations," which gives the ICJ authority to hear diplomatic disputes.

Palestine Sues United States Over Jerusalem Embassy

Palestine filed a complaint against the United States with the United Nations top court over Washington's decision to move the US embassy in Israel from Tel Aviv to Jerusalem.  In a statement issued on Friday, the International Court of Justice (ICJ) said Palestine contends the embassy's relocation is in breach of the 1961 Vienna Convention on Diplomatic Relations. In its application, Palestine argued that the treaty dictates embassies must be established on the territory of the receiving state and that the "special status of Jerusalem" means that the US violated its international obligations when it moved its embassy.

The Trump administration’s national security advisor John Bolton has never been a fan of international law, a concept he has found, at best, rubbery.  Any institution supposedly guided by its spirit was bound to draw the ire of both his temper and temperament.  Before members of the Federalist Society on Monday, Bolton took to the pulpit with a fury reserved for the unreflective patriot certain that his country, right or wrong, was above such matters.  “The United States will use any means necessary to protect our citizens and those of our allies from unjust prosecution by this illegitimate court.” The wicked body, in this instance, is the International Criminal Court, established by the Rome Statute to try instances of genocide, war crimes and crimes against humanity, a “court of last resort” backed by 123 nations.

Since the Nakba in 1947, Israel has displaced, brutalized and murdered Palestinians. The United States is Israel's biggest supporter and regularly provides cover for the crimes committed by Israel. For these reasons, residents of the United States have a responsibility to demand that Israel is held accountable for its war crimes. To that end, a letter is being circulated for individuals, political parties and organizations to sign calling on the International Criminal Court to investigate Israel for its crimes against Palestinians.

WASHINGTON (Reuters) - The Trump administration on Monday threatened tough action against the International Criminal Court should it try to prosecute Americans for alleged war crimes in Afghanistan and said the PLO’s office in Washington would be closed for seeking to punish Israel through the court. “The United States will use any means necessary to protect our citizens and those of our allies from unjust prosecution by this illegitimate court,” national security adviser John Bolton told the Federalist Society, a conservative group, in his first major address since joining President Donald Trump’s White House in April. The U.S. response could include sanctions against ICC judges should such prosecutions proceed, Bolton warned.

The ICC Just Announced It Will Treat War As A Crime

The International Court of Justice (ICJ) could try the United States for attacking a country if (1) that country brought a case, and (2) the United States agreed to the process, and (3) the United States chose not to block any judgment by using its veto power at the U.N. Security Council. War is a crime. The International Criminal Court has just announced that it will finally treat it as a crime, sort-of, kind-of. But how can war’s status as a crime effectively deter the world’s leading war-maker from threatening and launching more wars, large and small? How can laws against war actually be put to use? How can the ICC’s announcement be made into something more than a pretense? The Kellogg-Briand Pact made war a crime in 1928, and various atrocities became criminal charges at Nuremberg and Tokyo because they were constituent parts of that larger crime.
