Native American leaders vowed on Saturday to protest through the winter against a North Dakota oil pipeline they say threatens water resources and sacred lands and are planning lawsuits over police treatment of arrested protesters. Standing Rock Sioux Chairman Dave Archambault II said he and other tribal leaders were working on providing food, heat and shelter for protesters opposed to the $3.8 billion Dakota Access Pipeline. "We're just working through some technical details as far as where the land is, and the type of land that can be used for some permanent structures," Archambault told reporters in Mandan, North Dakota on Saturday morning. At least 10 shelters were being readied on tribal land against temperatures that can fall below -35 Fahrenheit (-37 Celsius) for days at time, he said.

Once again, as happened repeatedly over hundreds of years of struggle by Indigenous Peoples, the United States is using a militarized response against people seeking to protect the land and water and standing up for their human rights and justice. The militarized police are collaborating with oil companies and Indigenous people are having their civil rights trampled. The Water Protectors wrote the Department of Justice telling them about Indigenous drivers being harassed, the police conducting intrusive strip searches for minor offenses like trespass, the use of unlicensed guard dogs against protesters, as well as the use of military vehicles and militarized law enforcement. As Standing Rock Sioux Chairman Dave Archambault wrote “rather than seeking to keep the peace, law enforcement personnel are clearly working in tandem with private security of Dakota Access”who are escalating the conflict with peaceful water protectors.

The militarized police and the use of the National Guard this week in responding to the Standing Rock Sioux native American challenge in North Dakota to big oil and their dangerous pipelines reminds one of Custer’s Last Stand against Sitting Bull. On Friday more than 100 local and state police and North Dakota National Guard arrested over 140 people who blocked the highway attempting to stop the destruction of the land. Police in riot gear with automatic rifles lined up across a highway, with multiple MRAPs (mine-resistant ambush protected military vehicles). As this police mayhem was unfolding, a small herd of buffalo stampeded across a nearby field, a strong symbolic signal to the water protectors...

Pipeline Protesters Reportedly Detained Inside Dog Kennels

Under arrest for protesting against the construction of the Dakota Access pipeline, many activists accused the police of holding them inside cages that appeared to be dog kennels with each detainee receiving a number written on their arm. Although law enforcement agencies routinely arrest political and environmental activists, they have no constitutional right to psychologically antagonize their prisoners by marking them like Holocaust survivors. Since Thursday, at least 142 activists have been arrested while protesting against the North Dakota oil pipeline. On Friday, Sen. Bernie Sanders wrote a letter asking President Obama to intervene on behalf of the Standing Rock Sioux reservation. Calling for a Justice Department investigation into police tactics, Standing Rock Tribal Chairman David Archambault II told Reuters on Saturday, “Let’s reroute the pipeline. It doesn’t have to put our water at risk.” Since August 10, more than 400 protesters have been arrested, including actress Shailene Woodley and Democracy Now! journalist Amy Goodman. The rioting charges against Goodman were dismissed earlier this month.

More than 80 people were arrested in North Dakota on Saturday, as police armed with pepper spray descended on a protest near the Dakota Access Pipeline (DAPL) construction site. The 83 water protectors were hit with charges ranging from rioting to criminal trespass, according to the Morton County sheriff's department. Saturday's arrests follow reports of escalating police abuse at the protest sites, including beatings and unnecessary strip-searches of those arrested. On Twitter, Ojibwe activist and attorney Tara Houska wrote: Journalists, attorneys, indigenous protectors arrested & maced while demonstrating today. Whose interest is North Dakota protecting? Construction on the pipeline is continuing despite a request from the federal government to put a halt on activity so that the U.S. Army Corps of Engineers can properly consider objections.
