South Africa Presents The Case Against Israel’s Genocide In Gaza

The opening salvo of South Africa’s legal bid to hold Israel accountable for genocide in Gaza rang out this morning in a crowded courtroom in The Hague. The State of Israel has failed to prevent and is continuing to commit acts of genocide against the Palestinian people of Gaza, lawyers for the Republic of South Africa told the International Court of Justice, gathered in the ornate chambers of The Hague’s Peace Palace. Standing at a podium in front of the Court’s fifteen judges, supplemented by judges ad hoc Aharon Barak (Israel) and Dikgang Ernest Moseneke (South Africa), and in front of a battery of lawyers and scores of diplomatic observers, South African attorney Adila Hassim spelled out the acts Israel has committed against the Palestinian people of Gaza – acts defined as genocidal under Article II of the 1948 Convention on the Prevention and Punishment of the Crime of Genocide.

But in political terms the 84-page document that South Africa submitted to the Court represents the most powerful indictment of Israeli genocide that has been available to the public thus far. It not only documents the genocidal consequences of the Israeli massive bombing and siege of Gaza, but presents a complete file of official Israeli professions of determination to carry out genocide against the Palestinians population of the Gaza strip.

Israeli officials are gearing up for the hearing in the International Court of Justice (ICJ) tomorrow after South Africa filed a lawsuit in December accusing Tel Aviv of committing genocidal actions against Palestinians in the Gaza Strip. The ICJ hearings will broadcast live on Thursday and Friday. Unrestrained U.S. backing of Israeli military actions and bombardment in Gaza has immunized Tel Aviv from any scrutiny under UN resolutions. The ICJ ruling could end up as another international law that Israel does not respect. However, there is a high expectation for the Hague-based court to hold Israel accountable this time and implement a permanent ceasefire.

The government of Venezuela spoke up this Tuesday to confirm its support for South African authorities who, in a case filed with the International Court of Justice (ICJ), have accused Israel of genocide in Gaza, Palestine. In a statement, the foreign minister of Venezuela, Yván Gil cited the Israeli entity’s repeated violations of the Convention on the Prevention and Punishment of the Crime of Genocide. “Venezuela, as a country committed to peace diplomacy, recognizes South Africa’s firm and historic step in defense of the Palestinian people and international law,” wrote Gil. Likewise, he stated that Venezuela advocates that South Africa’s case be supported by the entire international community.

Bolivia has joined the ranks of countries who support South Africa’s historic case against Israel at the International Court of Justice (ICJ) for the ongoing genocide in Gaza. The Hague is set to initiate public hearings on the matter on January 11. In a statement on January 7, the Bolivian government recognized “that South Africa took a historic step in the defense of the Palestinian people, a leadership and effort that should be accompanied by the international community that clamors for the respect for life”. Bolivia was among the countries, including South Africa and Bangladesh, who had submitted an appeal to the International Criminal Court (ICC) on November 17 to investigate the crimes being committed in Palestine, including genocide.

The focus is on holding Israel accountable for alleged genocide in Gaza and putting an end to the tragic suffering of an imprisoned population. Delegations from major cities engaged with U.N. missions, embassies, and consulates from around the world, urging countries to invoke the Genocide Convention at the United Nations’ judicial arm.

For nearly three months, Israel has enjoyed virtual impunity for its atrocious crimes against the Palestinian people. That changed on December 29 when South Africa, a state party to the Genocide Convention, filed an 84-page application in the International Court of Justice (ICJ, or World Court) alleging that Israel is committing genocide in Gaza. South Africa’s well-documented application alleges that “acts and omissions by Israel … are genocidal in character, as they are committed with the requisite specific intent … to destroy Palestinians in Gaza as a part of the broader Palestinian national, racial and ethnical group” and that “the conduct of Israel — through its State organs, State agents, and other persons and entities acting on its instructions or under its direction, control or influence — in relation to Palestinians in Gaza, is in violation of its obligations under the Genocide Convention.”

The Israeli foreign ministry has ordered officials around the world to lobby diplomats and politicians to “issue statements against South Africa's case at the International Court of Justice (ICJ),” according to an internal cable reviewed by Axios. In particular, the cable highlights that Israel's “strategic goal” is for the ICJ, also known as the World Court, “to reject the request for an injunction, refrain from determining that Israel is committing genocide in Gaza, and recognize that the Israeli military is operating in the Strip according to international law.” “A ruling by the court could have significant potential implications that are not only in the legal world but have practical bilateral, multilateral, economic, security ramifications,” the cable highlights.

The collective West will forever stand disgraced and exposed due to its blind support of Israel’s genocidal slaughter of Palestinian civilians in Gaza since Oct. 7. What passes for governance in Washington, Berlin, Paris, London et al. has forced us all to bear witness to infanticide, high crimes and war crimes without end these past few months. South Africa is no longer alone in bringing its claim of genocide by the Israeli government to the International Court of Justice, following announcements from the Turkish Foreign Ministry and the Malaysian Ministry of Foreign Affairs that they support the case. Turkish Foreign Ministry spokesperson Oncu Keceli said Wednesday that those responsible for the killing of tens of thousands of Palestinians in Gaza since October 7 "must be held accountable before international law." "Israel's murder of more than 22,000 Palestinian civilians, the majority of whom were women and children, in Gaza for nearly three months should not go unpunished in any way," Keceli said.

United States - On December 30, the newly-formed International Coalition to Stop Genocide in Palestine convened around the urgent need for nations to invoke the Genocide Convention as a way to end the State of Israel’s devastating bombing campaign and additional war crimes being committed in the Occupied Palestinian Territories. That effort advanced on December 29 when South Africa submitted a well-documented case against Israel to the International Court of Justice. The Coalition strongly supports the call issued on January 2 by the Palestinian Anti-Apartheid Coordinating Committee urging governments to support South Africa’s complaint with Declarations of Intervention, which can be filed before or after the hearing, scheduled to take place on January 11 and 12, 2024.

West’s Support Of Israel: Hatred, Militancy Grow

The horrors that have been visited on the people of Gaza and increasingly the West Bank by the Israeli forces and by illegal settlers have been playing out in international media outlets. More than 20,000 people in Gaza, mostly non-combatants, have been killed. This includes more than 8,000 children and 6,200 women. The war crimes and crimes against humanity are obvious. They are not disputable. More ominous, a textbook case of genocide is unfolding before us all. The response by the “West”? “Israel has a right to defend itself”. It’s a settled fact of international law that an occupying power cannot use military force to attack a civilian population that it generally has complete control over.

South Africa has invoked the Genocide Convention, formally launching a case at the UN’s international court of justice accusing Israel of genocide for its mass atrocities in the Gaza Strip. Israel immediately responded by (deep sigh) accusing South Africa of “blood libel”. Blood libel, for those who don’t know, refers to the way medieval Europeans would falsely accuse Jews of murdering Christians in blood sacrifices in order to justify persecuting them. Which is to say, Israel has responded to South Africa’s accusations by accusing South Africa of anti-semitism.

The Hague, December 29, 2023 - South Africa today filed an application instituting proceedings against Israel before the International Court of Justice (ICJ), the principal judicial organ of the United Nations, concerning alleged violations by Israel of its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide (the “Genocide Convention”) in relation to Palestinians in the Gaza Strip.
