South Africa’s Case At World Court Also Exposes The US And The West

Cutting off water and electricity, bombing hospitals, and withholding food and medical aid all clearly fall within this definition. Not only has Israel publicly committed these acts, but its officials openly and publicly brag about having done so, and make South Africa’s case easy to prove. But if there is another point which is made obvious by this definition and that is that the United States has and is committing genocide domestically and internationally. Of course Black people played the biggest role in making this case beginning in 1951 when the Civil Rights Congress published the pamphlet, “We Charge Genocide ,” and documented the case against the U.S. government.

Mexico And Chile Call On ICC To Investigate Crimes In Gaza

Chile and Mexico have called upon the International Criminal Court (ICC) to investigate the crimes being committed amid Israel’s ongoing war on Gaza. In the past 105 days, Israel has killed over 24,600 Palestinians in Gaza, with more than 7,000 people missing and presumed dead under the rubble. In a statement released on January 18, Mexico and Chile stated that their referral to the ICC was “due to growing concern about the latest escalation of violence, particularly against civilian targets, and the alleged continued commission of crimes under the jurisdiction of the Court, specifically since the attack on October 7, 2023, carried out by Hamas militants and the subsequent hostilities in Gaza.”

Indonesia Files Lawsuit Against Israel At World Court

Israel’s Maariv newspaper reported that Indonesia has filed a new lawsuit against the Israeli occupation at the International Court of Justice (ICJ) in The Hague. In doing so, Indonesia joins South Africa, which filed the first lawsuit against Israel for committing genocide against Palestinians in Gaza. The Indonesian Foreign Ministry had previously assembled a team of experts to help draft Indonesia’s ICJ case to hold Israel accountable for its “policies and practices” in the occupied Palestinian territories. According to the local Jakarta Post website, Foreign Minister Retno Marsudi said that the case will help support global order based on international law, as well as support the Palestinians.

On 11 January, Adila Hassim, an advocate of the High Court of South Africa, stood before the judges of the International Court of Justice (ICJ) and said: ‘Genocides are never declared in advance. But this court has the benefit of the past 13 weeks of evidence that shows incontrovertibly a pattern of conduct and related intention that justifies a plausible claim of genocidal acts’. This statement anchored Hassim’s presentation of South Africa’s 84-page complaint against Israel’s genocide of Palestinians in Gaza. Both Israel and South Africa are parties to the 1948 Genocide Convention.

Icelanders Intensify Campaign Against Israel’s Genocidal War In Gaza

Progressive and anti-war groups in Iceland have intensified initiatives in solidarity with Palestine and against Israel’s ongoing genocidal war on Palestinians. The Iceland – Palestine Association and BDS Iceland have called for a demonstration on January 18 outside the office of the Icelandic National Broadcasting Service (RUV) in Reykjavík to urge the national broadcaster to challenge Israel’s participation in the upcoming Eurovision Song Contest 2024 organized by European Broadcasting Union (EBU) in Sweden. In the protest titled ‘United in Music – Torn Apart by Genocide’, several musicians in Iceland will deliver their petition urging RUV to refuse to participate in Eurovision alongside Israel which has been carrying out a genocide of the Palestinian people in Gaza.

Israeli President Isaac Herzog has been targeted with a criminal complaint during a visit to Switzerland, Swiss prosecutors said on Friday, amid allegations of crimes against humanity over the war in Gaza. The Federal Prosecutor’s Office (BA) confirmed that it had received a criminal complaint against the Israeli president, who was at the World Economic Forum’s annual meeting in Davos on Thursday to discuss the Gaza war. “The criminal complaints will now be examined in accordance with the usual procedure,” BA said in a statement, adding that it was in contact with the foreign ministry “to examine the question of the immunity of the person concerned”.

This past Wednesday night, January 10, I flew out from Newburgh, NY, headed toward Amsterdam and then to The Hague for the International Court of Justice hearing on South Africa’s charges of genocide against Israel. Usually I travel with my partner, Ellen Davidson, but as she had work commitments, I had to travel by myself. A little scary, as Ellen always does all the navigating. By myself I’m likely to get lost going around the block. Nonetheless, after traveling to the West Bank twice with VFP delegations and making Palestinian friends there, some of whom have been swept up and imprisoned after Oct. 7th, I felt compelled to go.

In a historic appearance before the International Court of Justice (ICJ or World Court) in The Hague, the legal team representing the Republic of South Africa presented a powerful and compelling case that Israel is committing genocide against the Palestinian people in Gaza. South Africa asked the court to impose nine emergency “provisional measures” to stop the slaughter. South Africa “unequivocally condemned the targeting of civilians by Hamas and other Palestinian armed groups and the taking of hostages on 7 October,” South African ambassador to the Netherlands Vusimuzi Madonsela said. But, he added, “no armed attack on a State’s territory no matter how serious — even an attack involving atrocity crimes — can provide any justification for, or defence to” genocide.

As with the South African case, according to court procedure the Israeli case was introduced on Friday by their “agent”, permanently accredited to the court, Tal Becker of the Israeli Ministry of Foreign Affairs. He opened with the standard formula “it is an honour to appear before you again on behalf of the state of Israel”, managing to imply purely through phrasing and tone of voice that the honour lay in representing Israel, not in appearing before the judges. Becker opened by going straight to the Holocaust, saying that nobody knew more than Israel why the Genocide Convention existed. Six million Jewish people had been killed. The Convention was not to be used to cover the normal brutality of war.

The United Nations Secretary-General and its Chiefs describe the situation in Gaza variously as “a crisis of humanity”, a “living hell”, a “blood bath”, a situation of “utter, deepening [and unmatched] horror”, where “an entire population” is “besieged and under attack, denied access to the essentials for survival”, “on a massive scale.”

The announcement that Israel has chosen Aharon Barak, the renowned former Supreme Court President, to join the International Court of Justice (ICJ) as it judges a landmark case charging Israel with genocide has sent the country into a tizzy. Barak will be Israel’s representative on a panel that is hastily being convened to discuss South Africa’s petition for an emergency suspension of Israel’s assault on the Gaza Strip — a panel that will consist of the ICJ’s 15 permanent judges plus one from Israel and one from South Africa. Barak has long been reviled by the Israeli right for having enshrined various liberal principles in the state’s quasi-constitution during his tenure as Supreme Court president from 1995-2006.

I attended the hearing on Thursday of South Africa’s case against Israel for genocide at the International Court of Justice. I was able to sit in the public gallery and watch all the proceedings. I was, however, handicapped in reporting by the fact that we were not allowed pens or pencils (though we were allowed paper). I asked the Head of Security at the ICJ why pens were not allowed in the public gallery. He told me, with a perfectly straight face, that they could be used as a weapon. So bereft of my deadly ballpoint, this account is less detailed and more impressionistic than I would wish to give you.

Namibia has criticised Germany’s “shocking decision” to support Israel in the genocide case at the International Court of Justice (ICJ) brought by South Africa, as Israel’s war on Gaza entered its 100th day. “Germany has chosen to defend in the ICJ the genocidal and gruesome acts of the Israeli government against innocent civilians in Gaza and the occupied Palestinian Territories,” the president of Namibia, Hage Geingob, said in a statement on X on Saturday. A two-day public hearing in the case at the World Court – the highest legal body of the United Nations – took place on Thursday and Friday during which South Africa and Israel presented their arguments.

The exhaustive 84-page brief submitted by South Africa to the International Court of Justice (ICJ) charging Israel with genocide is hard to refute. Israel’s campaign of indiscriminate killing, wholesale destruction of infrastructure, including housing, hospitals and water treatment plants, along with its use of starvation as a weapon, accompanied by genocidal rhetoric from its political and military leaders who speak of destroying Gaza and ethnically cleansing the 2.3 million Palestinians, makes a strong case against Israel for genocide. Israel’s smearing of South Africa as “the legal arm” of Hamas exemplifies the bankruptcy of its defense, a smear replicated by those who claim that demonstrations held to call for a ceasefire and protect Palestinian human rights are “anti-Semitic.”

Hundreds of millions of people across the world have been deeply moved by the atrocity of the Israeli war on Palestine. Millions have attended marches and protests, many of them participating in such demonstrations for the first time in their lives. Social media, in almost all the world’s languages, is saturated with memes and posts about this or that terrible action. Some people focus on the Israeli attack on Palestinian children, others on the illegal targeting of Gaza’s health infrastructure, and yet others point to the annihilation of at least four hundred families (more than ten people in each family killed).
