Keystone Leak Will Not Be Considered In Approval Of Pipeline

Nebraska lawmakers gave the five-member commission the power to regulate major oil pipelines in 2011 in response to a public outcry over the pipeline and its potential impact on the Sandhills, an ecologically fragile region of grass-covered sand dunes. But when they passed the law, legislators argued that pipeline safety is a federal responsibility and should not factor in the state decision. Opponents of Keystone XL are incensed that the leak won't be considered. "There is a reason TransCanada and the big oil lobby did not want this information on the record," said Jane Kleeb, director of the Bold Alliance, a coalition of groups that have opposed the Keystone XL for nearly a decade.

By Neela Banerjee for Inside Climate News - Most mornings, when his 7-year-old son Ryan gets up for school at 6:55, Bryan Latkanich is still awake from the night before, looking online for another home in some part of Pennsylvania with good schools and good water. Six years ago, Latkanich signed on to let an energy company tap natural gas beneath his property by pumping water, sand and chemicals into rock formations, a process called hydraulic fracturing, or fracking. Soon after, Latkanich's well water got a metallic taste, he developed stomach problems, and his son one day emerged from a bath covered in bleeding sores. More recently, Ryan became incontinent. Testing by state regulators and a researcher at nearby Duquesne University showed the well water had deteriorated since gas extraction started but no proof of the cause. The state recently began another round of testing. Latkanich is a single parent. He's jobless and blind in his right eye from brain surgery. "I worry about my son getting sick, about my getting sick and what would happen to him if I did," he said. "I'm doing this all alone. And I keep asking myself, 'How do we get out?'"

For indigenous communities, its when they are denied legal process. It is when their opinions, values, traditions and beliefs are not considered factors. In Tacoma, like at Standing Rock, that is exactly what is happening to the Puyallup Tribe of Indians. In fact, the likely winner of the Tacoma mayoral election, Victoria Woodards, is an ardent supporter of fracked gas as she erroneously believes that it’s an acceptable bridge fuel. Despite the facts being presented to her, she has never wavered from that opinion. Even when she was ejected from the Puyallup Tribes landing at the annual Canoe Journey, she didn’t waver. It’s no real surprise then that big financial backers for her election campaign were Puget Sound Energy, TOTE Maritime (who will be the primary customer of the LNG facility) and other Port of Tacoma interests. The outgoing Mayor, who Woodards succeeds, famously shut the doors on the several hundred Native Women who were marching to City Hall for the Citizens Forum. Colonial Racism is going strong in Tacoma even among groups who claim to stand against bigotry. Political expediency, it seems, is more important than that.

Ohio Overturns Ban On Cities Keeping Them From Voting Against Fracking

By Ruth Milka for Nation of Change - In a great victory for environmentalists and the people of Ohio, the Ohio Supreme Court struck down a provision that restricted citizen’s efforts to vote locally on banning fracking. The ruling is a turn around from earlier rulings that prevented residents from placing county charters and a city ordinance to ban fracking from appearing on ballots. In 2015, after the movement against fracking had progressed enough to include new county charters to elevate the rights of local residents and ecosystems, the Supreme Court ruled that the state has “exclusive authority” over oil and gas drilling. This meant cities and counties no longer had the right to ban or regulate fracking through any restrictions. Ohio’s Secretary of State Jon Husted supported the ruling, claiming he had “unfettered authority” to remove county charters from ballots, even if the people had gathered enough signatures. And it’s no wonder, as Husted is deeply tied to the Ohio Oil & Gas Association, who fundraise for him. Since 2015, Husted and his team of appointed county boards of elections, along with the state Supreme Court, have removed 10 proposed fracking-related county charters from Ohio ballots. Earlier this year, the city of Youngstown, Ohio spent $185,000 promoting anti-hydraulic fracking ballot measures, regardless of the state’s law. Even though city lawyers deemed that any regulation or ban that was passed with a vote would “not be enforceable,” the environmentalist group Community Environmental Legal Defense Fund, are pushing on.

By Staff of We Are Cove Point - For 18 weeks in a row now, We Are Cove Point has been holding rallies at the governor’s mansion in Annapolis to demand Maryland Governor Larry Hogan order a safety study for the fracked gas export terminal Dominion is building in the Cove Point neighborhood of Lusby in Southern Maryland. Each Monday at noon, we hold signs, pass out flyers and talk to passersby about the need for the governor to order this study, called a quantitative risk assessment. The governor is the only person who can order this study. This has been a continuation of a bigger campaign that’s stretched back into the administration of former Governor Martin O’Malley. Every once in a while, we catch Governor Hogan walking outside of his mansion. Yesterday was one of those days, and one member of We Are Cove Point had a very illuminating dialogue with him. We were walking around the state house during an event, handing out flyers and talking with people, when someone from We Are Cove Point spotted Governor Hogan and a few of his guards moving between the state house and the governor’s mansion.

Fracking Protesters Vow To ‘Put Their Lives On Line’

Two campaigners had to be rescued from an 18-metre (60ft) rig on Sunday after scaling the structure and waving flares – leading police to warn them of “the serious risk created by open flames and sparks on a live gas site.” The invasion of the gas exploration site in Kirby Misperton came as campaigners said they had seen a letter sent on behalf of the energy company Third Energy stating that fracking would begin “on or after Thursday”. The village, near the Flamingo Land theme park between Malton and Pickering, has found itself at the forefront of the war over Britain’s future energy needs since Third Energy had its fracking application approved in May 2016. The drill would be the first to take place in the UK since 2011, when minor earthquakes occurred in Lancashire after tests near Blackpool. Protesters have been at Kirby Misperton for more than a year and in recent weeks increased efforts to prevent vehicles entering the site, which Third Energy planned to begin fracking by the end of the year.

NY’s Fracking Ban Was Supposed To Set A Precedent…

Now, however, the state is poised to begin operating a power plant that will make fracking infrastructure fully operational throughout the state, completely undermining the ban. The $900 million power plant planned by Competitive Power Ventures (CPV) in Orange County, New York, requires permits for only two short pipelines before it may begin operating. CPV will be among the largest of New York's nearly 500 gas- and oil-fired power plants. Like more than half of currently proposed electricity generation in the state, this power plant will burn fracked gas from Pennsylvania's Marcellus Shale. Opponents charge that the plant is not needed and serves only to further push a warming world to the tipping point of climate-change catastrophe. On October 8, 2015, speaking with former Vice President Al Gore, New York Governor Andrew Cuomo said he would cut greenhouse gas emissions by 40 percent in the next 13 years, but climate scientists and engineers tell us CPV will emit 7 million tons of carbon-dioxide-equivalent pollution annually and add a full 10 percent from power generation to the state's current greenhouse gas inventory.

Government scientists are collecting water and air samples this week from about 25 homes in Dimock, a tiny crossroads about 150 miles north of Philadelphia. “Residents have continued to raise concerns about natural gas activities impacting their private water well quality,” the Agency for Toxic Substances and Disease Registry said Thursday in a statement to The Associated Press. Dimock was the scene of the most highly publicized case of methane contamination to emerge from the early days of Pennsylvania’s natural-gas drilling boom. State regulators blamed faulty gas wells drilled by Cabot Oil & Gas Corp. for leaking combustible methane into Dimock’s groundwater. Cabot, one of the largest natural gas producers in the state, has consistently denied responsibility, saying methane was an issue in the groundwater long before it began drilling. The ATSDR, a federal public health agency, said Thursday that it is “conducting an exposure investigation to determine if there are drinking water quality issues that may continue to pose a health threat.”

After years of meeting with legislators and state officials to ask for a safety study (known as a Quantitative Risk Assessment or QRA) on Virginia-based Dominion Energy’s fracking refinery, power plant and gas export terminal being built in Cove Point, we learned that the Governor “supports the project and will not order a safety study.” We believe it is possible for the Governor to support the project and have concerns about the health and safety of the thousands of families living close to Dominion’s facility. We can’t accept “no” as an answer because this is the first facility of its kind anywhere in the world to be placed in such a densely-populated area.

Cromwell says he’ll also launch a hunger strike. He’s one of six activists arrested for blocking traffic at the sit-in outside the construction site of the 650-megawatt plant in Wawayanda, New York, upstate, December 2015. The activists say the plant would promote natural gas fracking in neighboring states and contribute to climate change. James Cromwell is well known for his roles in some 50 Hollywood films, nominated for an Oscar in Babe, as well as a number of TV series, including Six Feet Under. I spoke to him Thursday along with one of his co-defendants who’s going to jail today, as well, Pramilla Malick, founder of Protect Orange County, a community group leading the opposition to the fracked gas power plant. She ran in 2016 for New York state Senate. I began by asking James Cromwell about why he’s going to jail today. Lusby, Maryland - For the past year, residents of Cove Point and their allies have petitioned Governor Larry Hogan with a very reasonable request: order a safety study (officially known as a Quantitative Risk Assessment or QRA) for the gas refinery, power plant and export terminal that Dominion Energy, a Virginia-based corporation, is building in Cove Point. Thousands of petitions have been delivered to the Governor. A letter signed by 84 organizations was delivered. Residents spoke personally with the Governor at parades and other events and met with his staff to present the concerns. On June 20, due to the lack of response from the Governor's office, a small delegation traveled to Annapolis yet again to request the safety study.
