US Legally Owes Reparations To Nicaragua; Refuses To Honor Ruling

The International Court of Justice in the Hague ruled in 1986 that the US government had violated international law in its attacks on Nicaragua and that it owed the Central American nation reparations. June 27, 2023 was the 37th anniversary of this ruling, and Washington still to this day refuses to pay Nicaragua the money that it legally owes it. The International Court of Justice (ICJ) is the judicial arm of the United Nations. (It is not to be confused with the International Criminal Court (ICC), which is independent of the UN. The ICJ was founded in 1945, in order to settle disputes between states; whereas the ICC was only formed in 2002, in order to prosecute individuals.)

ICJ Rules US Freezing Of Some Iranian Assets As Illegal

On Thursday, March 30, the International Court of Justice (ICJ) ordered the US government to pay compensation to Iranian companies for allowing its courts to freeze their assets, which the ICJ ruled as illegal. The UN court said that the exact amount of compensation will be decided later. The court, however, refused to pass a similar judgment regarding the US freezing US$ 1.7 billion of assets of the Central Bank of Iran (Bank Markazi), saying that it lacked jurisdiction over the matter. The ICJ was hearing a case filed by Iran in 2016. In 2016, the US Supreme Court had ruled that the assets of Iran’s central bank should be transferred to the relatives and survivors of the 1983 bombings of the US Marine barracks in Beirut, Lebanon.

International Court Of Justice To Weigh In On Climate For First Time

In a major diplomatic win for a Pacific nation extremely vulnerable to the climate crisis, the United Nations General Assembly on Wednesday adopted a resolution to ask the International Court of Justice (ICJ) to deliver a first-ever advisory opinion on climate change and human rights. The resolution, championed by Vanuatu, will ask the ICJ to clarify for the nations of the world what they are obligated to do under international law to protect the environment and human rights from the impacts of clearing forests and burning fossil fuels. “Today we have witnessed a win for climate justice of epic proportions,” Vanuatu Prime Minister Ishmael Kalsakau said in a video statement.

UN Committee Votes To Request ICJ Opinion On Israeli Occupation

The United Nations' decolonisation committee adopted a draft Palestinian resolution on Friday requesting an advisory opinion from the International Court of Justice (ICJ) on Israel's occupation of Palestinian lands since 1967. The measure was welcomed by Palestinians and rejected by Israel. Palestinian Foreign Minister Riyad al-Maliki said in a statement that 98 countries supported the resolution, 52 abstained and 17 voted against. The opinions of the ICJ, which settles disputes between countries, are not binding. Al-Maliki welcomed the vote and described the resolution as a "diplomatic and legal breakthrough" that would "open a new era for holding Israel accountable for its war crimes". The resolution will now go to the 193-member General Assembly for a final vote before the end of the year.

ICJ Rules Iran Has Legal Claim To $2bn In Assets Frozen By US

The International Court of Justice (ICJ) has ruled that Iran has the right to recover two billion dollars in frozen assets in the United States.  In a ruling issued on Wednesday, the 15-member court in The Hague said Tehran can proceed with a bid to recover the assets, which Washington says must go to victims of attacks blamed on Iran. Judges rejected US claims the case should be thrown out because Iran had "unclean hands" from alleged links to "terrorism", and the international tribunal in The Hague did not have jurisdiction over the lawsuit.
