On Thursday morning, before the Senate Judiciary Committee, Christine Blasey Ford detailed under oath her claim that Supreme Court nominee Brett Kavanaugh attacked her and sexually violated her when he was 17. On Thursday afternoon, Kavanaugh went before the committee to defend himself from the charge, emotionally—sometimes angrily—claiming that he was an innocent man being persecuted by Democrats, that his hearings had become a “national disgrace” that had “destroyed my family and my good name.” The two witnesses, Ford and Kavanaugh, were both steadfast in their stories. The hearing did not offer any obvious moments that would decimate either party’s claims. Some viewers may have left not knowing what to believe: Ford was clear and responsive.

Far from being unusual, the hurried and partisan Supreme Court confirmation process for Brett Kavanaugh mirrors several notable examples of similarly politicized confirmations in U.S. history. Those conflicts, which ultimately placed justices on the court, yielded some of the most damaging civil rights decisions in our nation’s history. Unlike any other branch of government, Supreme Court justices do not have to face voters at the polls. They have no term limits. Yet the high court is the final arbiter of constitutional rights and protections.

Liberal Democrats are out to get Brett Kavanaugh. They are right to be; he is dangerous. Confirming Kavanaugh to the Supreme Court would lock in a right-wing majority for a generation. Abortion rights would be imperiled, true, but his rulings would also impact us in countless ways no one can predict: privacy, technology, balance of powers, corporate influence. What’s weird is how the “Resistance” is going after the nominee: they’re #MeToo-ing him. They’re only #MeToo-ing him. One woman says he tried to rape her when she was 15 and he was 17. Another says that he pulled out his penis and shoved it in her face at a college party. U-S-A! Best country ever! At this writing a third accuser waits in the wings. If true these are—obviously, undeniably, absolutely—nasty acts.

In the he hearing, Flake said he wanted a one-week delay for the FBI to investigate the allegations. A motion calling for an FBI investigation would very likely have passed 11-10 along party lines with Flake joining the Democrats. He said that was what he wanted but never made such a motion. Roll Call reported “Ranking member Dianne Feinstein could be heard on a still-hot microphone questioning whether they had voted on the Flake proposal. Grassley insisted, because of committee rules, ‘we had to be done with this by 2 [p.m.].’ Staff then cut the microphones.” Flake still could slow the nomination. On Friday afternoon it was reported that after a dramatic series of closed-door meetings with senators from both parties, he said that he would “only be comfortable” voting yes in the end after the FBI investigates a sexual assault allegation against Kavanaugh.

Christine Blasey Ford has shown remarkable bravery in speaking out about an attempted rape she experienced over 35 years ago. But it’s hard not to fear what comes next. She will tell her story — one she no doubt remembers with painful clarity — but there will be no smoking gun, no undeniable forensic evidence, and in the end, Brett Kavanaugh may well be confirmed as the newest Justice on the Supreme Court. Ford’s detractors will say she cannot be believed because she was drinking. They will say her memory is unreliable. They will ask why she waited so long to come forward, not realizing that questions like that are exactly why. What they won’t ask is how she found the courage to come forward at all.

In order to get to the warehouse in Spokane Valley on time, she'd wake up around 5 or 6 am in her home in Kellogg, Idaho, where she lived with her mom and brother. She'd work all day, barely stopping to eat. Sometimes, she'd stay until 11 at night, knowing that she'd have to drive back in the morning, or that she'd get a call at 2 am from a driver who needed a problem solved. She says she easily worked 90 to 120 hours per week. Yet she was only paid for 40 hours a week, at $11 an hour. Other drivers for Diamond Freight, based in Yakima, had similar complaints. They were paid a flat rate of $110 per day, yet they were required to work more than 40 hours per week with no overtime pay, as mandated by state and federal law. "They were like, we're not paying you anything over 40 hours. Nobody's worth it," Thomas says. "But the job has to get done."

In a win for increased transparency and those demanding an end to the so-called "dark money" eating away at U.S. democracy, the Supreme Court on Tuesday lifted a previous stay on a lower court ruling by rejecting the argument by right-wing advocacy groups who said they should not have to reveal the identity of big-dollar donors who fund their issue-based campaign ads. Crucially, the ruling means that groups that in the past have been able to hide the source of their funding before, during, and after campaigns will have now have to make that information available before voters go to the polls—in this case, that means before the upcoming mid-term elections.

DES MOINES, Iowa (AP) — A group of Iowa landowners and an environmental group asked the Iowa Supreme Court Wednesday to declare a crude oil pipeline permit illegal under the Iowa Constitution, a decision that could force the pipeline in operation for more than a year to be turned off. The attorney for a group of landowners who opposed construction of the Dakota Access oil pipeline through their property told the court since the pipeline provides no direct use to Iowans the decision of the Iowa Utilities Board to grant a permit should be reversed. “The pipeline crosses the state with no oil wells, no refineries, this pipeline has no onramps and no offramps,” said Bill Hannigan. “Iowans have no direct use.”

Trump Supreme Court Nominee Brett Kavanaugh was subject to a wringer of testy Senate confirmation hearings last week. The current DC Circuit Court judge has come under fire from Democrats on the Judiciary Committee for his stances against the landmark pro-abortion decision Roe v. Wade, affirmative action and programs for Native Hawaiians, as well as his support for torture. But some Democrats have also said that Kavanaugh lied under oath in both current and past hearings, and groups like Free Speech for People, Demand Justice, MoveOn and NARAL Pro-Choice America have all advocated perjury probes against him. However, these serious allegations of perjury have received sparse coverage from establishment media outlets like the New York Times, Washington Post, CNN and NPR.

Arizona Supreme Court Hears Hopi Tribe’s Case Against Snowmaking

Oral arguments in the Hopi Tribe’s lawsuit against Arizona Snowbowl’s snowmaking practices were heard by the Arizona Supreme Court’s panel of seven justices on Tuesday, Sept. 4. In February, the Arizona Court of Appeals revived the question of whether Snowbowl's snowmaking with reclaimed wastewater causes “special injury” to Hopi religious and cultural sites. The case was originally filed in the Coconino County Superior Court for the issue rooted on the San Francisco Peaks just outside of Flagstaff’s city limits. This is the third case the Hopi Tribe has brought against the ski resort. In his opening statement, John Egbert, counsel for Snowbowl, alleged that the appellate court mischaracterized the issue in its ruling and ended up creating a new category for special injury.

Leaders of the Women’s March are determined to disrupt Brett Kavanuagh’s confirmation hearing for the Supreme Court and, while their presence was seen and heard on Day 1, more than 30 women were arrested yesterday. Alongside Women’s March co-founders Linda Sarsour and Bob Bland, women from many different backgrounds, including women from 20 different woman’s organizations from across the nation, gathered in Washington, D.C. at Kavanuagh’s confirmation hearing. Their goal: “to look our Senators in the eye and remind them that women across America are watching.” According to a press release, “women were dragged out of the hearing without warning from police officers.” “Women are disrupting this hearing today because our lives are at risk,” Rachel O’Leary Carmona, Chief Operating Officer of Women’s March, said. “Women will die if Kavanaugh is confirmed.”

What Brett Kavanaugh On Supreme Court Could Mean For Climate Regulations

In his dozen years on the federal appeals court that hears the most disputes over government regulatory power, Judge Brett Kavanaugh has compiled an extensive record of skepticism toward the government's powers to act on climate change. In particular, while Kavanaugh has repeatedly voiced the belief that global warming is a serious problem, he has challenged the argument that Congress has given the Environmental Protection Agency authority to do something about it. That means the 53-year-old jurist, if approved by the Senate to fill the vacancy left by Justice Anthony Kennedy, could harden the high court for the next generation as a blockade to climate action that isn't explicitly mandated by Congress. Though Kennedy was hardly a reliable vote for environmental protection, he was the pivotal vote in Massachusetts v. EPA, the 5-4 decision that in 2007 established that greenhouse gases were a pollutant that fit "well within" the EPA's authority to regulate under the Clean Air Act.
