Democrats Sneak Patriot Act Extension In Through Bill To Fund Government

With federal agencies set to run out of money this week, House lawmakers today passed a short-term funding bill that contained a nasty surprise. Tucked into the end of this must-pass legislation, in a section titled “Other Matters,” is language reauthorizing three Foreign Intelligence Surveillance Act (FISA) authorities currently set to expire on December 15, 2019. The new expiration date would be March 15, 2020. The extension of these surveillance authorities, even for three months, is bad enough.

The first attempt to check the FBI political surveillance was in 1924. Harlan Fiske Stone read a report by the ACLU about the FBI doing political spying. He was so concerned by it, he made J Edgar Hoover meet with Roger Baldwin, the head of the FBI. Stone did not know that Hoover was spying on Roger Baldwin and the ACLU. He put into place a regulation that the FBI had to stick to investigating violations of the criminal code and he asked Hoover, can you show us anywhere where it's illegal to be a communist? Hoover found ways to get around that. The FBI is very good at finding reasons to spy on people. But then in the 30s, there was a whole bunch of national executive orders from Roosevelt that gave the FBI very broad national security powers. So, this isn't a new issue, but you know some of the ideas that have been proposed over the last almost 100 years are still very good ideas.

BOSTON—In a major victory for privacy rights at the border, a federal court in Boston ruled today that suspicionless searches of travelers’ electronic devices by federal agents at airports and other U.S. ports of entry are unconstitutional. The ruling came in a lawsuit, Alasaad v. McAleenan, filed by the American Civil Liberties Union (ACLU), Electronic Frontier Foundation (EFF), and ACLU of Massachusetts, on behalf of 11 travelers whose smartphones and laptops were searched without individualized suspicion at U.S. ports of entry.

Israeli Spyware: WhatsApp Hack Raises Global Fears

In the middle of October this year, the world’s biggest messaging platform, WhatsApp, started sending out alerts to select users advising them that their security had been compromised. The messages were sent after security researchers found that an Israeli company had been supplying spying software that specifically targeted WhatsApp users. Once the targeted device is hacked through WhatsApp, it makes all the data on the phone available to the spies. Everything on the phone, be it email or other messaging platforms or photographs and documents, can then be easily accessed by the spy agency using the Israeli spyware.

Berkeley, California became the fourth U.S. city to pass a ban on all government use of facial recognition technology on Tuesday night following a unanimous yes vote by the City Council. Two other cities in the state, Oakland and San Francisco, have already passed their own bans on government use of facial recognition tech, while Governor Gavin Newsom recently signed a bill banning its use on police body cams for several years. Somerville, Massachusetts, also passed a similar law this summer.

American Airlines has started using facial recognition technology on passengers at boarding gates, part of a growing industry trend that airlines and airports say will make travelling faster and more secure. American is using the technology at Dallas/Forth Worth International Airport in Texas, where passengers can get their face scanned instead of using their boarding pass to board the plane,local news station CBS 11 News reported. Passengers, however, still need both their boarding pass and an ID, like their passport, to get through airport security.

The FBI and several other law enforcement agencies have been keeping tabs on pipeline opponents in southwest Oregon, according to documents obtained by the Guardian. Opponents of the natural gas pipeline project have been monitored for years and information about the activists has been shared between law enforcement agencies and even with non-government firms, including Off The Record Strategies — an anti-environmental public relations agency that helped craft a message against the Standing Rock activists opposing the Dakota Access Pipeline two years ago, according to the Guardian.
