Environmental groups are pushing back on the Trump administration’s decision to expand fracking in California. A lawsuit filed in Los Angeles on Tuesday challenges the Bureau of Land Management’s plan to open more than a million acres of public lands in Central California to oil and gas leasing, Common Dreams reported. Anticipation is building around the belief that there could soon be an announcement of at least a partial settlement of U.S. lawsuits pitting thousands of U.S. cancer patients against Monsanto Co. over allegations the company hid the health risks of its Roundup herbicides. Investors in Bayer AG, the German company that bought Monsanto in 2018,  are keeping a close eye on the status of three trials currently still on the docket to get underway this month.

Atlantic Coast Pipeline Loses Permit Battle With Historically Black Community

A federal appeals court rejected a needed permit for the Atlantic Coast Pipeline on Tuesday, the latest legal blow to the controversial pipeline as it heads to the Supreme Court through another case. The unanimous decision from the 4th Circuit Court of Appeals in Richmond, Va., was a victory for Union Hill, a community founded by freed slaves after the Civil War. Residents challenged Dominion Energy’s plans to build a gas-powered compressor station for the pipeline in the community, arguing the project would lead to poor health conditions for the largely black community. 

In Sea-Watch And No More Deaths Cases, Courts Rule That Saving Lives Isn’t A Crime

After six months of detention at the Sicilian port of Licata, the Sea-Watch 3 humanitarian search and rescue ship is now free to resume its operations in the Central Mediterranean. On Dec. 19, Sea-Watch, a German NGO, finally won an appeal to the Italian civil court securing the ship’s release. Human rights advocates deemed its confiscation and sustained detention to be both illegal and racist — with the aim of preventing the ship from rescuing primarily black Africans and bringing them to Italy for safe harbor.

2020: A Year Of Pipeline Court Fights, With One Lawsuit Headed To The Supreme Court

After years of mounting opposition to the increasing build-out of oil and gas infrastructure, 2020 is shaping up to be the year that pipeline opponents get their day in court. One case headed to the U.S. Supreme Court takes a closer look at whether parts of the Appalachian Trail are off-limits to fossil fuel infrastructure and may determine the fate of two multi-billion-dollar pipelines. A defeat there, the industry argues, would severely limit its ability to get natural gas from the Marcellus shale to East Coast cities and export terminals. Another case weighs state sovereignty against pipeline interests and could have implications nationwide.

Climate Change On Trial: Can The Courts Save The Planet?

Can ordinary citizens use the courts to force their leaders to fight climate change? In the most revolutionary climate ruling to date, the Supreme Court of the Netherlands delivered an emphatic “yes” on December 20, upholding a court order forcing the Dutch government to cut national carbon emissions.  In the wake of the decision, a group of children and young people in the US is hoping to gain traction in a similar legal battle (Juliana v. United States) as they claim the right to live in the same climate as previous generations.

I am satisfied that there is a reasonable basis to proceed with an investigation into the situation in Palestine, pursuant to article 53(1) of the Statute. In brief, I am satisfied that (i) war crimes have been or are being committed in the West Bank, including East Jerusalem, and the Gaza Strip ("Gaza") (for specifics, see paras. 94-96); (ii) potential cases arising from the situation would be admissible; and (iii) there are no substantial reasons to believe that an investigation would not serve the interests of justice. As there has been a referral from the State of Palestine, there is no requirement to seek Pre-Trial Chamber's authorisation before proceeding to open an investigation, and I do not seek to do so.

Six Monsanto Roundup Cancer Trials Set For January

After several months out of the headlines, lawyers for both sides of the nationwide Roundup cancer litigation are gearing up for overlapping trials in the new year as several more cancer patients seek to blame Monsanto for their diseases. Six trials are currently set to take place starting in January, with one in February, two in March and additional trials scheduled almost every month from April through October 2021. Thousands of additional plaintiffs still are working to get trial dates set for their claims.

A US Human Rights Group Is Being Sued By Pro-Israel Organizations Over An Alleged Connection To ‘Balloon Terror’

The US Campaign for Palestinian Rights (USCPR) is the target of a $90 million lawsuit that accuses the group of engaging in environmental terrorism. The legal action was brought forward by the Keren Kayemeth LeIsrael-Jewish National Fund (KKL-JNF) and 12 Americans citizens who live in Israel last month. Although they’re identified as the KKL-JNF in Hebrew, the group is widely known as the Jewish National Fund. ‘David-and-Goliath Story’ As Texas Environmental Activist Diane Wilson Wins $50 Million Judgment Against Plastics Giant Formosa

Environmental activist Diane Wilson on Tuesday celebrated the approval of a settlement with plastics giant Formosa Plastics Corp. that will see the company devote $50 million to remediating areas of the Texas Gulf Coast it polluted. U.S. District Judge Kenneth M. Hoyt approved the settlement (pdf), which was reached in October. "If this isn't a David-and-Goliath story, I don't know what is," tweeted Texas Tribune reporter Kiah Collier.

Internet service providers like Comcast and Verizon are free to slow down, block or prioritize internet traffic as they wish, without interference by the federal government. That’s the effect of an October ruling by the D.C. Circuit Court of Appeals, upholding a 2017 ruling by the Federal Communications Commission that reversed rules requiring what is called “net neutrality” – treating all internet traffic equally, regardless of where it’s from or what kind of data it is. Not Guilty: Jurors Acquit Border Aid Volunteer Scott Warren On Harboring Charges

Federal court jurors in Tucson drew a line between harboring and help on Wednesday, when they acquitted border aid worker Scott Warren on felony charges for the assistance he gave to two Central American men last year. The not guilty verdict came after just 2.5 hours of deliberation, and it was greeted with cheering, laughter and tears from Warren’s supporters and fellow aid workers, including a contingent of clergy members from across the country. “The government failed in its attempt to criminalize basic human kindness,” Warren told the crowd outside the downtown courthouse after it was over.

Court Decision Against BLM For Ignoring Climate Impact Results In Suspended Oil & Gas Leases

The Trump administration's relentless push to expand fossil fuel production on federal lands is hitting a new snag: its own refusal to consider the climate impacts of development. The federal Bureau of Land Management's Utah office in September voluntarily suspended 130 oil and gas leases after advocacy groups sued, arguing that BLM hadn't adequately assessed the greenhouse gas emissions associated with drilling and extraction on those leases as required by law.
