Media Serve The Governors, Not The Governed

In his 1971 opinion in the Pentagon Papers case, U.S. Supreme Court Justice Hugo Black wrote: “In the First Amendment the Founding Fathers gave the free press the protection it must have to fulfill its essential role in our democracy. The press was to serve the governed, not the governors. The Government’s power to censor the press was abolished so that the press would remain forever free to censure the Government.” That’s what WikiLeaks and Julian Assange have been doing since 2006: censuring governments with governments’ own words pried from secrecy by WikiLeaks’ sources—whistleblowers. In other words, WikiLeaks has been doing the job the U.S. constitution intended the press to do. One can hardly imagine anyone sitting on today’s U.S. Supreme Court writing such an opinion.

Robinson’s speech, which was broadcast live on the state-funded Australian Broadcasting Corporation, contained a sharp warning on Assange’s plight and the implications of the US attempt to prosecute him. Assange, she said, would not survive years’ more incarceration and “persecution by process.” And if he were extradited from Britain to the US and hauled before a kangaroo court for publishing true information, it would be a dagger blow to freedom of the press and democratic rights. The address was a rare breach in a wall of silence on the Assange case in Australia. His various court dates have been given cursory coverage, but there has scarcely been any television programming or substantive reporting on the persecution of an Australian citizen and journalist.

Doctors For Assange sent a letter to United States Attorney General Merrick Garland and the United Kingdom Home Secretary Suella Braverman yet again expressing their concern about the deteriorating health of WikiLeaks founder Julian Assange. The coalition of over 300 doctors, psychiatrists, psychologists, and other medical professionals have repeatedly called for Assange’s release from Her Majesty’s Prison Belmarsh in London and protested “health injustices” that have occurred as a result of the extradition case against him. Worsening matters, as Doctors for Assange notes, is the fact that Assange tested positive for COVID-19 on October 8. “Given his chronic lung ailment, Mr. Assange may be at increased risk of serious illness resulting from COVID infection,” the doctors write.

They debate arcane legal nuances to distract from the Dickensian farce where a man who has not committed a crime, who is not a U.S. citizen, can be extradited under the Espionage Act and sentenced to life in prison for the most courageous and consequential journalism of our generation. The engine driving the lynching of Julian is not here on Pennsylvania Avenue. It is in Langley, Virginia, located at a complex we will never be allowed to surround – the Central Intelligence Agency.

World-Wide Backing As Parliament Encircled For Assange

Thousands of supporters of Julian Assange descended upon London’s Palace of Westminster to form a human chain around the Houses of Parliament in support of the embattled WikiLeaks publisher on Saturday. Meanwhile, the London action was backed up by rallies in Melbourne, Australia, Washington D.C., San Francisco and other locales. In the British capital, men and women from a myriad of backgrounds attended the demonstration from across the U..K, and beyond, including from France, Germany and the United States. It was the first known human chain to surround the Houses of Parliament. Stella Assange, wife of the imprisoned publisher, said around 5,000 people showed up to form the chain despite a nation-wide strike announced by the National Union of Rail, Maritime and Transportation Workers (RMT). Other estimates put the crowd as high as 7,000.

On Saturday, October 8, thousands of people in the UK gathered for a massive act of solidarity with political prisoner and WikiLeaks founder Julian Assange. Protestors formed a human chain around the Parliament in London to demand that the government cancel Assange’s looming extradition to the US, and for him to finally be freed. Stella Morris, Assange’s partner, told The Independent that the action had been organized because Parliament was the “seat of democracy” and that Assange represented “democracy at its strongest— government accountability and democratic movement…It is to remind people that this is a political case, and his imprisonment is politically motivated.” Morris added that it had been “energizing” for Assange to know that he had support.

Thousands have marched through Melbourne's city centre calling for the release of WikiLeaks founder Julian Assange. The 51-year-old Australian has been in London's Belmarsh prison since he was removed from the Ecuadorian embassy in 2019. Melbourne protesters marched through the city streets and formed a human chain across a Southbank bridge on Saturday morning as they called on the Australian government to intervene. "There's an expectation in the electorate that the prime minister and this government is going to get Julian out of jail," Mr Assange's brother Gabriel Shipton told AAP. "The prime minister's statements before the election - enough is enough, he doesn't see what purpose is served by Julian being kept in prison - those were seen as a commitment.

I had occasion to visit London and Jerusalem to meet with members of the (establishment) media, of the two respective parliaments and people from think tanks and universities. I took this trip to talk with interested parties about a human rights case. Mazi Nnamdi Kanu, leader of a group called the Indigenous People of Biafra (IPOB), is being held in solitary confinement in a prison in Nigeria. His crime? He gave an interview to the BBC in which he said that Nigeria’s 70 million Biafrans want a referendum on independence. Nnamdi is a British citizen; his wife and child live in Manchester, England. He renounced his Nigerian citizenship years ago. In the spring of 2021, Nnamdi was in Kenya to meet with Biafrans to discuss independence from the corrupt, violent and Muslim fundamentalist government of Nigeria.

Don’t Charge Trump With Espionage

Former President Donald Trump shouldn’t be charged with espionage for taking classified documents with him —some of them apparently very highly classified — when he left the White House for semi-retirement at his Mar-a-Lago home. Nobody should be charged with espionage unless they are working for a foreign power and mean harm to the United States. The Espionage Act, which was written 105 years ago to combat German saboteurs, is rarely used now to target spies and traitors. Instead, it’s used as a cudgel to silence whistleblowers, journalists, and occasionally a stupid former president. To understand the damage that this deeply flawed law has done, and will continue to do, we have to look at its origins. The Espionage Act was written in 1917, at the height of World War I. The U.S. was panicked at the thought of German spies working undercover to steal its secrets and to disrupt its ability to produce war materiel and support its allies.

Today, 26 August 2022, Julian Assange is filing his Perfected Grounds of Appeal before the High Court of Justice Administrative Court. The Respondents are the Government of the United States and the Secretary of State for the Home Department, Priti Patel. The Perfected Grounds of Appeal contain the arguments on which Julian Assange intends to challenge District Judge Vanessa Baraitser’s decision of 4 January 2021, and introduces significant new evidence that has developed since that ruling. The Perfected Grounds of Appeal concerning the Secretary of State for the Home Department (SSHD) include arguments that Home Secretary Priti Patel erred in her decision to approve the extradition order on grounds of specialty and because the request itself violates Article 4 of the US-UK Extradition Treaty.
