Spain Is First European State To Back ICJ Genocide Case Against Israel

Spain filed a Declaration of Intervention on 28 June in the case accusing Israel of genocide at the International Court of Justice (ICJ), becoming the first European state to do so. “This intervention is motivated by our responsibility as a State party to the Genocide Convention and our firm commitment to international law,” said the Spanish Foreign Ministry. In December, South Africa brought the case against Israel to the ICJ, the world’s highest court, alleging that Israel’s ongoing war on Palestinians in Gaza is a breach of the Genocide Convention. “We seek to contribute to bringing peace back to Gaza and the Middle East,” the Spanish Foreign Ministry added, emphasizing the need for a two-state solution to ensure lasting peace and stability for Palestinians and Israelis.

The Colombian Ministry of Commerce, Industry and Tourism published a decree according to which the country will stop selling coal to Israel in an attempt to pressure Tel Aviv to stop its genocide of Palestinians in the Gaza Strip. “This decree will enter into force after five calendar days… and will remain valid until the orders of provisional measures issued by the International Court of Justice in the process of applying the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip are fully complied with,” states the decree published on Friday, June 7.

Seven months into its genocidal campaign, Israel’s assault on Rafah led the International Court of Justice (ICJ) to issue a preliminary order on May 24. The court called on Israel to “Immediately halt its military offensive, and any other action in the Rafah Governorate, which may inflict on the Palestinian group in Gaza conditions of life that could bring about its physical destruction in whole or in part.” It also ordered Israel to keep the Rafah crossing open and permit United Nations investigative commissions to enter Gaza and investigate allegations of genocide. In addition, mounting Israeli atrocities propelled Karim Khan, chief prosecutor of the International Criminal Court (ICC), to seek arrest warrants on May 20 against top Israeli officials.

When Nicaragua accused Germany of aiding and abetting Israel’s genocide in Gaza at the International Court of Justice (ICJ) last month, readers of corporate media might have seriously wondered whether Nicaragua’s case had any legitimacy. The case targeted Germany as the second biggest supplier of arms to Israel, because the US, Israel’s biggest supplier, does not accept the court’s jurisdiction on this issue. The object (as Nicaragua’s lawyer explained) was to create a precedent with wider application: that countries must take responsibility for the consequences of their arms sales to avoid them being used in breach of international law.

Israel escalated its attacks on civilians in Gaza on 24 May in response to the International Court of Justice (ICJ) ruling ordering Israel to cease its military operation in the southern Gaza city of Rafah. Friday's ruling by the ICJ came as part of an ongoing case to determine if Israel is committing genocide in Gaza. The ruling is a provisional measure to halt Israeli military action in response to its ongoing attack on Rafah, which has killed hundreds of Palestinians and displaced hundreds of thousands who had already been displaced by Israeli bombing in Gaza's north. Prime Minister Benjamin Netanyahu denied the allegations in the case brought by South Africa that Israel was carrying out genocide in Gaza as "false, outrageous and morally repugnant."

The International Court of Justice (ICJ) ordered Israel on 24 May to halt its military offensive in Rafah as part of the ongoing genocide case filed by South Africa earlier this year. “[Israel must] immediately halt its military offensive, and any other action in the Rafah Governorate, which may inflict on the Palestinian group in Gaza conditions of life that could bring about its physical destruction in whole or in part,”  ICJ President Nawaf Salam said. The top UN court said that the current situation entails further risks of “irreparable damage” to the rights of Palestinians in Gaza and that conditions have been met for new emergency measures.

South Africa asked the International Court of Justice (ICJ) on Thursday to order Israel to halt its Rafah offensive, and argued that the assault posed a risk to "the very survival of Palestinians in Gaza." South Africa's ambassador to the Netherlands, Vusi Madonsela, asked the court in his opening remarks to "do what it can to stop the genocide," which he said had "shocked the conscience of humanity." He added that South Africa's fourth submission to the court was triggered not only by the assault on Rafah but by an intensification of the Israeli assault across Gaza in the last few days.

The kidnapping of Glas, who has faced political persecution through Ecuador’s judiciary since 2017, sparked international outrage as a blatant violation of the Vienna Convention and Mexico’s sovereignty. Mexico cut off diplomatic relations with Ecuador and has taken Ecuador to the International Court of Justice for this violation.

 South Africa filed an “urgent request” on Friday with the International Court of Justice (ICJ) for additional measures amid Israel’s attacks on Gaza, particularly in the city of Rafah, where more than 1.4 million Palestinians are taking shelter. “In its new request, South Africa states that the provisional measures previously indicated by the Court are not capable of ‘fully address[ing]’ the changed circumstances and new facts on which [its] Request is founded,” the ICJ said in a statement.

The International Court of Justice (ICJ) has rejected a German request to throw out the Nicaraguan case accusing it of facilitating Israel's genocide in Gaza, allowing the case to proceed. Presiding Judge Nawaf Salam, who delivered the world court’s decision on Tuesday, said that the ICJ remains “deeply concerned about the catastrophic living conditions of the Palestinians in the Gaza Strip”. However, the court ruled by 15 to one against issuing any emergency measures against Germany over its arms exports to Israel, arguing that the current circumstances did not require them.

When it comes to tangible action, this case has been one of the few bright spots in an otherwise lackluster response from states around the world to the Israeli slaughter of the Palestinian people. One of the lesser known parts of this story in Western public discourse generally, but more pertinently within activist spaces, is that the US empire is threatening to punish South Africa for bringing this much needed case against Israel.
