Federal Judge Won’t Block Voter ID Law That Strips Native Americans Of Their Voting Rights

A federal judge in North Dakota has denied an emergency motion that sought to seek relief for Native Americans against a state voter ID law that will make it so that “hundreds, perhaps thousands of Native Americans” will not be able to vote in next week’s elections. Although U.S. District Court Judge Daniel Hovland expressed that there is a “great cause for concern” in regards to the law, he ruled against the motion because it would cause more confusion and chaos so close to the election. “The federal courts are unanimous in their judgment that it is highly important to preserve the status quo when elections are fast approaching,” Judge Hovland wrote.

Standing Rock Water Protector Reaches Non-Cooperating Plea Agreement

MANDAN, NORTH DAKOTA – On Thursday February 8, Michael Giron will appear in federal court in Bismarck for a change of plea hearing as per the terms of a non-cooperating agreement with prosecutors. Mr. Giron, who is known as Little Feather, was charged with Civil Disorder and Use of Fire to Commit a Federal Felony Offense, arising from events of October 27, 2016. Under this plea agreement, the Use of Fire charge – which carries a mandatory minimum sentence of 10 years and the possibility of up to 15 years in prison – will be dropped entirely, and Little Feather will take responsibility for aiding a civil disorder. Subject to the acceptance of the plea agreement by Judge Daniel Hovland, who is presiding over the case, prosecutors and the defense will jointly recommend a sentence of 36 months on the Civil Disorder charge, although the judge does have the authority to go as high as five years.

The article includes a quote from the Wall Street Journal that reads, "An internal White House review of strategy on North Korea includes the possibility of military force or regime change to blunt the country’s nuclear-weapons threat, people familiar with the process said, a prospect that has some U.S. allies in the region on edge." The BI article also states: Military action against North Korea wouldn't be pretty. Some number of civilians in South Korea, possibly Japan, and US forces stationed in the Pacific would be likely to die in the undertaking no matter how smoothly things went.

The oil-friendly legislature argues that its constituents are frustrated over the protests, which led federal authorities to halt construction of the $3.8-billion Dakota Access Pipeline as thousands of protesters braved cold weather and violence for months. A bill that state GOP Rep. Keith Kempenich introduced would exempt drivers from liability if they accidentally hit a pedestrian, according to the Bismarck Tribune. House Bill 1203 was written up in direct response to groups of protesters blocking roadways, Kempenich told the paper. He claims protesters were seen jumping out in front of vehicles.

Filmmaker Arrested At Pipeline Protest Facing 45 Years In Felony Charges

Deia Schlosberg, the producer of the upcoming documentary “How to Let Go of the World and Love All Things Climate Can’t Change,” was detained while filming a protest against TransCanada’s Keystone Pipeline in Walhalla, North Dakota. Activists at the event, associated with the group Climate Direct Action, shut down the pipeline, which carries oil from Canadian tar sands to the U.S, for about seven hours. Two of the protestors, Michael Foster and Samuel Jessup, were also charged and Schlosberg’s equipment and footage from the event was confiscated. Schlosberg said shortly after being released on bond that she couldn’t comment on her arrest until she spoke to a lawyer. She has been charged with three felonies: conspiracy to theft of property, conspiracy to theft of services and conspiracy to tampering with or damaging a public service. Together, the charges carry 45 years in maximum prison sentences.
