Medicaid Work Requirements Struck Down By Unanimous Federal Court Of Appeals

In a decision which warmed my heart on a cold Valentine’s Day here in Washington, the federal Court of Appeals issued an unanimous opinion striking down the Arkansas work requirements waiver.  In doing so, it upheld district court Judge Boasberg’s decision vacating the Arkansas’ Section 1115 waiver (including most famously Medicaid work requirements) because it was “arbitrary and capricious” and therefore violated the Administrative Procedures Act.

Mistrial Is Another Blow To US Coup In Venezuela; Our Work Continues

Last week, we along with Adrienne Pine and David Paul were unsuccessfully prosecuted by the Trump administration for our protection of the Venezuelan embassy in Washington, DC from April 10 to May 16, 2019.  The jury was unable to reach a unanimous decision and so we remain innocent of the charge of interfering with the protective functions of the US Department of State. The judge declared a mistrial. It was a partial victory and we greatly appreciate the jurors who were able to see through the cloud of misinformation in the courtroom and vote to acquit us. The day our trial started, Juan Guaido returned to Venezuela where he was harassed and physically assaulted by protesters. He is unable to muster support at home even from the opposition.

Journalist Abby Martin Sues State Of Georgia Over Law Requiring Pledge Of Allegiance To Israel

After refusing to sign a pledge of allegiance to the state of Israel, the state of Georgia shut down a media literacy conference featuring journalist and filmmaker Abby Martin at Georgia Southern University. Martin had recently released a documentary critical of the Israeli government called “Gaza Fights for Freedom.” Now she is suing the state, claiming the decision is a violation of the First Amendment.

Embassy Protectors Will Not Be Able To Tell Jury Guaido Is Not President, Or Mention International Law

On February 4, Chief Judge Beryl A. Howell issued a ruling on what the jurors will be allowed to be told in the trial of the Embassy Protectors scheduled to begin on February 11. She granted most of the government’s requests to prevent the jury from hearing important facts about the case, leaving the protectors with little in the way of a defense. The courtroom will not be an oasis of truth in Washington, DC. The fact that Nicolas Maduro is the lawful president of Venezuela, not the coup leader Juan Guaido, cannot be uttered in that courtroom.

Brazilian Judge Delays “For Now” Decision On Indictment Of U.S. Journalist Greenwald

BRASILIA (Reuters) - A Brazilian judge indicted six people accused of hacking the phones of prosecutors in the country’s biggest corruption case on Thursday, but held off “for now” on accepting cybercrimes charges against U.S. journalist Glenn Greenwald. The judge, Ricardo Soares Leite, said the Supreme Court had to rule first on an earlier injunction shielding Greenwald from investigation before he could decide on the indictment, which charges Greenwald.

Judge Reverses Convictions Of No More Deaths Volunteers

TUCSON, AZ – On January 31st, United States District Judge Rosemary Márquez reversed the convictions of four No More Deaths volunteers. The volunteers were convicted in January 2019 of multiple misdemeanor charges stemming from their humanitarian aid work on the Cabeza Prieta National Wildlife Refuge (CPNWR) during the summer of 2017 in an area known as the “trail of death.”

Iranian Student Deported From Boston Despite Court Order; Federal Judge Dismisses Case

U.S. Customs and Border Protection officials at Logan International Airport denied entry to an Iranian national who was set to study economics this spring at Northeastern University. Despite a federal court order to delay the man's removal, CBP placed him on a plane Monday night. Kerry Doyle, an attorney for Mohammad Shahab Dehghani Hossein Abadi, said the 24-year-old was traveling to the U.S. with a valid F1 student visa before he was held for secondary questioning by CBP at the Boston airport.
