Three years ago, I visited Old Supreme Court Building in Hong Kong, also known as The Court of Final Appeal, together with my friend, an Afghan-British lawyer, who was on a personal mission of ‘re-discovering Asia.’ Coming from a prominent, highly educated family in Afghanistan, my friend was extremely well aware that both the United States and the United Kingdom thoroughly destroyed her country during the recent occupation. In fact, under the NATO boots, Afghanistan became the poorest country in Asia, with the lowest life expectancy. But after the long journey through Asia, somehow, she became nostalgically attached to Hong Kong. It looked familiar. As she studied and practiced law in the U.K., The Court of Final Appeal Building looked familiar and reassuring to her.

Over the past few decades, Western countries—such as the United Kingdom, but more so the United States of America—have flouted international laws and failed to even try to uphold the high-minded principles of the charter. Most recently, the United States has attempted to muzzle the International Criminal Court (ICC) as it has pursued a perfectly reasonable investigation into war crimes in Afghanistan; and the United Kingdom has denied Venezuela its sovereign right to gold held in the Bank of England. In both cases, the United States and the UK have undermined the sovereignty of nations and mutilated international law. The lawlessness of the governments of Prime Minister Boris Johnson and President Donald Trump is better explored through their actual practices than through the high-minded speeches of their ambassadors to the United Nations.

The English High Court ruled earlier this month that the virtual and self-proclaimed “interim president” (Washington’s puppet) Juan Guaido and not the Venezuelan state should administer the 31 tonnes of gold reserves stored in the UK (1). This debacle proves that national and international law are no longer worth a dime, and represents a contemporary act of stale piracy by ancient Albion (2). The trial in England for Venezuela's blocked assets began in London on June 22 and concerned US $1.3 billion of state property. For decades, successive governments, even before Chavez, used the country’s gold bars in the Bank of England's underground vaults in international financial transactions. Twenty percent of the world's gold is kept in these vaults, in what is a legacy to colonial-time dynamics.

The fact that the UK High Court cites the UK government’s recognition of Juan Guaidó as the reason for blocking access to the gold is farcical. The UK government has formally recognised Guaidó as “interim president”, but maintains full consular and diplomatic relations with Venezuela and its legitimate government. There is a Venezuelan ambassador in London and a British ambassador in Caracas. Furthermore, the Venezuelan government had pledged that proceeds from the repatriation of the gold reserves would only be used, under supervision of the UN Human Development Program, in the fight against the COVID-19 pandemic in Venezuela. By continuing to illegally withhold the Venezuelan gold, the UK is endangering lives in Venezuela.

The United Kingdom's High Court Thursday decided that opposition lawmaker Juan Guaido can access 31 tons of Venezuelan gold held in the Bank of England, which prevents President Nicolas Maduro's administration from using those resources to fight the pandemic. The ruling about this monetary reserve valued at over US $ 1 billion occurs after months of disputes between Venezuela and the Bank of England, which denied the constitutionally constituted government access to its own resources On May 14, the Central Bank of Venezuela (BCV) sued the Bank of England to obtain and sell the Venezuelan gold bars. The South American country intends to sell the resources to the United Nations Development Program (UNDP), and so gain food and medicine needed amid pandemic.

The systematic and collective appropriation of Palestinian land by the State of Israel is not an accident of British colonial history. Palestinians are not the Chagos Islanders of the Eastern Mediterranean, a people considered by the UK government to be too weak and scattered to bother about. The dispossession of Palestinian land was a product of British foreign policy. Lord Balfour may not have intended a Jewish state when he issued his declaration in 1917 recognising the rights of Jews to set up a "homeland", a deliberately ambiguous phrase. At that point, two percent of Palestine was owned by Jews. In an exchange of letters with George Curzon, Balfour’s successor as foreign secretary, Balfour was unsupportive of the aspiration of the Zionist leader Chaim Weizmann for a Jewish state.

One of John Pilger’s most remarkable documentaries, bringing a little-known story to a wide audience, is Stealing a Nation, about how British governments ruthlessly expelled the population of the Chagos Islands, a crown colony in the Indian Ocean, in the late 1960s and early 70s to make way for an American military base on Diego Garcia, the largest island. The truth about the brutal removal of 1,500 islanders and the official conspiracy to deny the presence of an indigenous population did not emerge for another 20 years. Secret official files were unearthed at the Public Record Office, in London, by lawyers acting for the former inhabitants of the coral archipelago, who wished to return to their homeland. Historian Mark Curtis described the enforced depopulation in Web of Deceit, his 2003 book about Britain’s post-war foreign policy.

Venezuela Sues The United Kingdom Over Frozen Gold

In January 2019, the Bank of England froze over $1.2 billion worth of Venezuela’s gold, refusing to release it to the democratically elected government and contributing to the deadly economic crisis caused by the Trump administration’s ongoing regime change efforts. Now Venezuela is suing the Bank of England and the trial is happening this week! The Venezuelan government isn’t even asking that the money be returned to them. Instead, they want the funds transferred to the United Nations Development Program so that this UN agency can buy food and medicine on behalf of the country to help it weather the COVID-19 pandemic. The Trump administration has been working since 2017 to get other countries to join its cruel sanctions. The United Kingdom was one of the first countries to heed the call, disregarding the unconscionable cost to human life and Venezuela’s economy.

The government is being urged to suspend the sales of British tear gas, rubber bullets and riot shields to the United States amid fears they are being used against civil rights protesters. The US has been rocked by angry demonstrations for nearly a week following the death of George Floyd, a black man who died pleading for air while a Minneapolis police officer pressed a knee into his neck for eight minutes. The police response, apparently endorsed by president Donald Trump, has seen security forces ramming crowds with cars, deploying gas and baton rounds against peaceful demonstrators, and arresting and shooting at domestic and international journalists covering events. Government records show it grants export licences worth millions of pounds for the sale of anti-crowd gas, riot equipment, so-called “rubber bullets” and other small arms to the US – but the government’s own rules say such exports should not go ahead where they are likely to be used for “internal repression”.

The UK’s Palestine Solidarity Campaign won what it said was a historic legal victory for the boycott, divestment and sanctions movement on Wednesday. BDS campaigners celebrated as the Supreme Court in London struck out an anti-divestment rule imposed by the government in 2016. As the ruling was made by the UK’s highest court, it cannot be appealed. The Conservative government in September 2016 imposed a new guideline which stopped local authorities using their pension schemes to divest from Israel or any other country – regardless of human rights concerns. The rule stated that councils must not use their pension policies “to pursue boycotts, divestment and sanctions against foreign nations and UK defense industries.” But the Palestine Solidarity Campaign challenged the government, and in 2017 the High Court ruled in its favor.
